The Attorney General (AG) contended that it had already appealed against the decision of the Circuit Court that convicted Antwi at an Accra High Court and the appeal was being heard.

When the application for Certiorari was called at an Accra High Court, Mrs Yvonne Attakora Obuobisa, the Chief State Attorney, explained that hearing of the Appeal had begun already at another High Court.

Mr Francis Xavier Sosu, who represented Charles Antwi and the Mental Health Authority, therefore, told the court that his team would go through the appeal of the State to enable members to take a decision for the next sitting.

According to Sosu, after reading through the affidavit in opposition filed by the State, they may withdraw the application and join the State in appealing against the conviction.

The court, presided over by Mr Justice K.A. Okwabi, consequently, adjourned the matter to August 24, for the team to respond to the affidavit in opposition and advise themselves.

Mr Sosu had gone to court praying it to declare that Charles Antwi was a mental patient and must be sent to the psychiatric hospital for treatment and also to quash the jail term imposed on him.

Meanwhile, the Attorney General had on, Thursday, filed a similar application at the Accra High court seeking to set aside the judgment by the circuit court that sentenced Antwi.

The State was of the view that, the trial judge, Mr Justice Francis Obiri erred in his judgment because there was an error on the face of the record, while Charles was sent to court only to be remanded.

It is, therefore, seeking a retrial and a thorough mental examination of the convict.
