Justice Ahmed Mohammed of the Federal High Court in Abuja has fixed January 29 for the hearing of the preliminary objection filed by the Peoples Democratic Party (PDP) challenging its jurisdiction to entertain a suit by 79 members of the House of Representatives, who defected to the All Progressives Congress (APC).
The 79 defected lawmakers, who moved from PDP to APC, had approached the court for an order restraining the PDP from declaring their seats vacant following their defection.
During the proceedings of the court, counsel to PDP,  Chief Joe-Kyari Gadzama (SAN), told the court that based on prevailing circumstances, ?we have filed a notice of preliminary objection to the originating summon and it is contained in our written address in support of our counter affidavit in line with Order 16 of the Federal High Court rules. 2013.
After making his submissions to support his application, he urged the court to grant his request to argue the preliminary objection orally.
