A high court in Kumasi has issued a restraining order against lawyer Kwame Adofo, barring him from disclosing any information about the Komfo Anokye Teaching Hospital (KATH) on social media platforms, including Facebook and WhatsApp.
The court order, issued on 4 July and obtained by Asaase News, is part of a defamation lawsuit brought by KATH against Adofo, who served as the hospital’s solicitor from 2018 to 2023.
According to the court’s ruling, Adofo is prohibited from disclosing “any information about the plaintiff between 2018 and 2023 which came to his actual or constructive knowledge from management, workers, or third parties dealing with the plaintiff hospital.”
The order further prevents Adofo from making “any post on any of the defendant’s social media platforms, be it WhatsApp, Facebook, Instagram, or any other place, on all matters concerning the plaintiff and its operations.”
Additionally, the court directive mandates that Adofo refrain from discussing “KATH’s operations on radio or television… pending the final determination of the suit.”
KATH initiated legal action against Adofo on 31 January 2024, accusing him of publishing sensitive information about the hospital’s operations on traditional and social media platforms. The hospital characterized Adofo’s conduct as “unprofessional” and highlighted that similar concerns had been reported to the General Legal Council.
In its lawsuit, KATH seeks various remedies, including removing all statements and comments concerning the hospital from Adofo’s Facebook page and offering an unconditional apology.
The court’s intervention underscores the escalating legal tensions between KATH and its former solicitor, reflecting broader privacy issues and professional ethics within Ghana’s legal and healthcare sectors.
