Lindsay dodges legal minefield


Lindsay Lohan has dodged a legal minefield after police confiscated alcohol in the trunk of the car she is accused of totalling on Friday, according to reports.

Law enforcement sources tell TMZ the 25-year-old actress had a plastic water bottle filled with alcohol in the rented Porsche that ploughed into a truck in Santa Monica.

Fortunately for Lindsay, who is on probation from an unrelated incident, it is not a violation in the state of California to drive with an open container in the trunk.

Police tell TMZ the bottle was found in the ‘debris field’ and ‘scooped up along with other parts and placed in the trunk before it was towed away.’

The comments contradict reports from a tow truck driver at the scene who told the website the water bottle was confiscated directly from the trunk.

The actress, who was taken to UCLA hospital with her assistant after the incident, reportedly had no alcohol in her system.

Both women, and the driver of the truck, identified by RadarOnline as James Johnson, are said to have emerged uninjured.

Lindsay was back at work this week after the whole fiasco, reportedly refusing to allow producers to halt filming because of her latest personal drama.

The troubled actress, who is trying to get her career back on track, is currently lensing Lifetime biopic Liz & Dick, about the late Elizabeth Taylor’s relationship with Richard Burton, and was pictured looking glamourous as ever in a black kaftan, her eyes shielded by white sunglasses.

Behind the scenes, however, her plan to put her legal woes behind her after a series of jail stints and probationary periods, seems to be unraveling.

Yesterday, reports emerged she could have probation revoked after lying to police about not being behind the wheel of the car before the collision in Santa Monica on her way to set.

The actress remains on probation in a necklace theft case, but is no longer being supervised by a judge or probation officer.

Speculation is mounting about what exactly unfolded at the scene of her accident.

According to TMZ, a law enforcement source said the Lindsay told police it was her assistant who was driving her black Porsche.

Eye-witnesses say both women hopped out of the passenger side of the vehicle.

When police questioned the actress’ assistant separately, the employee allegedly put the blame on Lindsay, claiming her boss was in fact the one behind the wheel at the time of the collision.

The Santa Monica Police Department is said to have discovered the contradiction when they visited Lindsay in hospital.

TMZ claims that the police will include the fact that Lindsay lied in their report.

Under California law, it is offense to provide false information to law enforcement.

That means Lindsay could now run the risk of getting her probation revoked from her shoplifting case last year, and may go to jail if found guilty.

The actress is said to have told friends the accident was down to a mechanical failure.

After the driver of the truck came forward to claim that the accident was entirely her fault, Lindsay is said to have confessed to pals she couldn’t have avoided the crash because the brakes had failed

The man in question, James Johnson, told TMZ that he was driving 40mph and was following the rules of the road when he felt the impact of Lindsay’s Porsche.

He said: ‘She came over and hit the back of the truck. Then the car pulled up on the sidewalk.’

And he claims he can prove it, with the help of eyewitnesses who were at the scene.

He said: ‘They have a video of this whole incident.’

Meanwhile, sources told TMZ that Lindsay is insisting that the truck driver has made the whole story up in a possible attempt to extort money out of her.

The story appears to be bolstered in claims by RadarOnline Johnson filed for bankruptcy in February, 2011, listing a $80.00 in cash assets and $57,000 in debts.

The website reports the Compton-based truck driver is considering possible legal action against the actress.

Police have confirmed alcohol was not a factor in the crash, which remains under investigation.

The accident is the latest vehicular mishap for Lindsay, who had her driver’s license restored in August 2010 after losing her driving privileges because of a pair of DUI arrests in 2008. She is still being sued by three men who claim she forced them to remain in a sport utility vehicle she commandeered and used to chase a woman she thought was her assistant on Pacific Coast Highway.

That incident ended in the parking lot of the Santa Monica Police Department, where the actress was arrested.

She is also being sued by a pedestrian who claims Lindsay struck her in West Hollywood, California, in September 2010. That civil case is still pending.

Friday’s accident comes after the Los Angeles District Attorney’s Office last month determined there was insufficient evidence to pursue a case against the actress in a nightclub manager’s claim that the actress struck him with her sports car.

The prosecution said there was a lack of evidence in the case.
