Supreme Court sets a date for Decision on Anti-LGBTQI+ Bill Injunctions

The Supreme Court of Ghana has scheduled July 17, 2024, for delivering rulings on interlocutory injunctions sought in two lawsuits challenging Parliament’s passage of the contentious anti-gay bill.

Broadcast Journalist Richard Dela Sky and Researcher Dr. Amanda Odoi, in their individual capacities, have filed separate suits contesting the constitutionality of the Human Sexual Rights and Family Values Bill. Sky seeks a declaration that the bill breaches constitutional provisions and human rights, while Dr. Odoi raises concerns over specific provisions and seeks to restrain key parliamentary officials from sending the bill to President Akufo-Addo for approval. Their personal commitment and dedication to this cause is evident in their actions.

Chief Justice Gertrude Torkornoo, the presiding judge, informed the court that the cases would not be consolidated, following a request by Attorney-General Godfred Yeboah Dame.

Dr. Ernest Ackon, counsel for Dr. Odoi, argued that the bill imposes an unconstitutional charge on public funds under Article 108, highlighting the absence of a fiscal impact analysis. On the other hand, Attorney-General Dame countered that the Speaker’s discretion is constitutionally bound. This disagreement underscores the tension and high stakes involved in this legal battle.

The court, chaired by Chief Justice Gertrude Torkornoo, is currently hearing arguments in the case brought by Richard Dela Sky.
