Your Motion Has No Merit – Court Tells Gyakye Quayson

An Accra High Court has thrown out a motion by the embattled Member of Parliament (MP) for Assin North, James Gyakye Quayson.

He filed the motion against the three of the five criminal charges filed against him to be struck out.

The MP through his lawyers led by Tsatsu Tsikata urged the Court to strike out the 3rd, 4th and 5th charges of the deceit of knowingly making a false declaration; forgery of passport or travel certificate, and making a false declaration for office.

According to a report, the legal team argued that the said charges bothered on article 94 (2)(a) and required interpretation whilst the other two other charges of perjury and false declaration of office were however not contested.

James Gyakye Quayson was in February slapped with the five criminal offences by the Attorney-General’s Office and subsequently granted a ¢100,000 bail with one surety.

When he appeared before court on Wednesday, June 1, 2022, Tsatsu Tsikata in his submission said the charges do not meet provisions in Article 19 (11) of the 1992 Constitution which provides a framework for ensuring a fair trial by providing sufficient particulars of the offence being complained of.

The Attorney General’s office in a counter argument said all the five criminal charges were provided for by Statute.

Dorcas Felli, a State Attorney, insisted that sufficient information had been provided and accused the MP’s legal team of attempting to waste the time of the court, saying that “All particulars are precise enough to give accused persons what the charges are about,” the State Attorney is quoted by citinewsroom to have said in court.

Meanwhile, the Presiding Judge, Her Ladyship Mary Maame Ekue Nsenkyire after listening to submissions from both sides, dismissed the motion, saying it is without merit and adjourned the court to July 12, for the commencement of trial.
