Police Detective Chief Inspector Oscar Amponsah told the Court that on November 16, around 0630 hrs, the complainant, James Ayitey, a small scale miner, based in Tarkwa visited his mining site at Booboobo, a suburb of Tarkwa.

Inspector Amponsah said while at the site, he saw eighty-three pieces of iron rods placed behind his machine shop.

He said Ayitey decided to wait patiently for the person who will show up and claim ownership of the item.

Inspector Amponsah said at about 0900hrs, on the same day Kwofie came and claimed to be the owner of the iron rods.

He said the complainant then subjected the accused person to series of questions but he refused to disclose his source.

Kwofie was then arrested and sent to the Tarkwa police station by the complainant, where a formal complaint was lodged

The accused person in his cautioned statement informed the police that he bought the iron rods at a cost of GH¢90, 000 from a driver at Samahu, near Tarkwa.

Kwofie claimed that even though he did not know the name of the said driver, he would be able to identify him whenever he set yes on him.
