Randy Abbey and Charles Ntim a businessman based in Sunyani entered into an agreement with the RDPM Founder to abandon his party and join the NDC to campaign with the understanding that he (Raphael Cubagee) will be provided with a pick-up, vehicles and some unspecified amount of money as compensation.

However, after exhausting all his time, money and energy as well as resources to campaign as agreed, nothing has come from Randy Abbey and his team as agreed upon.

According to the writ entered at the High Court in Sunyani, the plaintiff stated that, he was a staunch member of the NDC until about three days ago when he resigned from the said political party and founded the Real Democratic Patriotic Movement (RDPM) after which Randy Abbey and Charles Ntim pleaded with him to abandon the RDPM and join the NDC so that he campaign for the NDC on condition that they will provide him with a brand new pick-up and an unspecified sum of money, which he reluctantly accepted.

The plaintiff says that on 23rd of September 2012, the defendant had conference with him at the EUSBETT Hotel in Sunyani in room no. 141 whereby it was agreed between the parties that the defendant will provide the plaintiff with a pick-up to enable the plaintiff to tour all the constituencies in the Brong Ahafo region and other part of the country to campaign for the NDC.

The writ also indicated that, ?it was further agreed between the parties that the plaintiff should start the campaign immediately, even before the arrival of the vehicle, with his own money so that the defendant will reimburse the plaintiff.?

?The plaintiff says that on 26th of September 2012, he held a press conference at the Citi Yeboah rest house (formerly Caterine Rest House) to the effect that he had resigned from the RDPM and rejoined the NDC and the said conference was telecast on both radio and national television and also in the newspapers.?

It was also stated that, Raphael Cubagee, based on the agreement, took some quantity of T-Shirts with President John Mahama picture embossed on them, posters and caps from Randy Abbey and his colleague, and he toured all the constituencies in the Brong Ahafo Region and some part of the country and campaign for the NDC with that campaign many people who resigned from the NDC have rejoined the NDC.

According to Raphael Cubagee, he has exhausted all his funds, energy, time to campaign for the NDC but the defendants have failed to perform their part of the contract or agreement by providing the plaintiff with a brand new pick-up, vehicle and money.

Raphael Cubagee has taken to case to court and claiming an order that the defendant provide him with the brand new pick-up with vehicle and a substantial sum of money as agreed upon between the parties at the conference held by the parties at the Eursbett Hotel, Sunyani in room no. 141 on 23 September 2012.

However, the Sunyani High Court has recommended that within eight days, after service of the writ, Randy Abbey and Charles Ntim, cause an appearance to be entered for them or failure to do so, judgement may be given in their absence without further notice to them.
