Nana Konadu Agyeman Rawlings might have second thoughts about the NDC logo which they so urgently needed after the revelations by legal brains that her request cannot be granted as easily as they have so many wanted.

According to lawyer Raymond Bagnabu, Nana Konadu will be knocked out without a contest if the case is sent to the Court because apparently, she could be the first to register the logo, but she is not bounded by copyright because they are not the original guardian of the design.

“You don’t have to register a work for copyright recognition enjoy”. He said

“If you go and register a copyrighted work, if the work does not originate from your idea or even your effort, then your registration per se won’t help you” because the protection of copyright will protect only the originator of the work.

Having regard to the argument of the lawyer and the fact that Nana Konadu is not the principal or the one who sat down to the logo design, will her struggle for the ‘ Umbrella ‘ a total failure.

Lawyer Raymond Bagnabu created the concerns known on e. tv Ghana’s breakfast TV on Monday morning.

When asked by the host, Bismark Brown, about what Nana Konadu must do in such circumstances; Bagnabu lawyer indicated that the former first lady must be able to demonstrate that they are the initiator of the logo is.

“She has to prove that they are the originator of the work; that work, the symbol or logo came out of her own idea. That they single-handedly just sat down and got it “. He said

“Copyright does not depend on registration only registration will prove you’re the owner, but where someone else the idea in the form of a logo has produced” than copyright protects the designer.

Abraham Amaliba who appeared on the show in its previous submission said, the NDC must be sought for an alternative logo for the December polls to prevent any last-minute hitch in the party campaign to retain power.

In his eyes, there is no need to be pampered in a legal battle with Mrs. Rawlings, since that could derail the efforts in the elections.

“She has registered and so it seems she is the owner of the logo. There is a long legal battle that could come but are we ready for this at such a crucial moment? ” He asked.

“There might be an injunction on the logo as one of the two parties goes to Court and who will be the loser?”

Abraham Amaliba the view, the administrator of the copyright at the time of the registration by Nana Konadu must be held responsible for the void (if any existed).

He doesn’t understand why there was no cross-checks before the registration was done considering the fact that it had to be done in the interest of a major political party such as the NDC.

To downplay the meaning of symbols, he said that Ghanaians won’t look logos of political parties, before they go to the polls and to resolve issues, so a new design should be determined by the party.

“If we do not solve this problem, then we need to start looking for an alternative symbol. People will not vote result of symbols, but policy.

The former first lady reminder two weeks ago the ruling NDC Government through its legal team to take them back if the logo will respect shall not be granted for her family.

She also asked that the Government ruling to the ideals of honesty and accountability that were embraced by her husband, ex-President Jerry John Rawlings returns.
