Agona Swedru Chief loses land dispute case

The Cape Coast Court of Appeal has dismissed an appeal on land dispute, filed by Nana Kojo Acquah, Tufuhene of Agona Swedru, and four others, for non- compliance of Constitutional Instrument(CI) 19 of 1997.

The four in the suit were Kojo Amoah , Samuel Mensah, and the trustees of the Agona Swedru branches of the Churches of Pentecost and the Twelve Apostles.
The three-member panel presided over by Mr Justice Clement J Honyenuga, explained that the appeal was struck out because the appellants failed to file written submissions, which CI 19 of 1997 enjoined them to do,
The two other panel members were, Mr Justice Ackah-Yensu, and Alhaji Saeed Kweku Gyan.

A cost of 500 Ghana Cedis was awarded against the appellants.
They lost the substantive case at the Agona Swedru High Court in November last year, which was filed by Mr Kweku Gyedu and Mr Kwame Gyan of the Yoko Family, claiming 240 acres of land belonging to their ancestors.
The High Court ruled that the disputed land belonged to the Yoko Family, and for that matter, they were entitled to it.
