NCA’s bid process in attaining Wimax operator rights challenged

maxA legal tussle appears to be brewing between the National Communications Authority (NCA) and business mogul Togbe Afede XIV.

This is after the business mogul dragged the National Communications Authority to court over the authority?s bid process in attaining Wimax operator rights in the country.

WiMAX is a wireless communications standard designed to provide 30 to 40 megabit-per-second data rates with the 2011 update providing up to 1 Gbit/s for fixed stations.

WiMAX is similar to Wi-Fi but on a much larger scale and at faster speeds.
Togbe Afede the XIV explained to Citi Business News further why it hurled the authority to court.

According to him, they ?are in court with NCA because when NCA advertised its Wimax bids we put in a bid but NCA failed to follow its own procedures. So we took them to court contesting what they did to deprive us of a license. They invited us for a pre auction meeting then they cancelled the meeting at short notice and they promised to invite us when the meeting was rescheduled but we heard nothing from them.?

Togbe Afede XIV currently has investments in aviation, energy, real estates and sports among others.

Wining the bid would have seen him play a major role in the telecom sector which is dominated by foreign entities.

Togbe Afede told Citi Business News the Authority went contrary to its laid down procedures insisting ?the right thing was not done so our deposits should be refunded to us which, is fair. You invited us to a pre auction meeting you cancelled it and you never got back to us but you are still keeping our 50,000 dollars deposit.?

He described as ?common sense and natural justice will require that you will give us back our money, so we are pursuing them. So yes telecom was interesting to us and we had a plan to link all of West Africa on a common mobile platform that has been frustrated by the NCA.?
