Ofori-Atta Lawyer Challenges Special Prosecutor’s Medical Remarks

Ken Ofori-Atta’s legal team has sharply criticized Special Prosecutor Kissi Agyebeng for allegedly overstepping his mandate by questioning medical documentation and disclosing private health information.

Lead counsel Davies, speaking to Accra-based JoyFM, challenged Agyebeng’s qualifications to assess medical reports submitted to excuse the former Finance Minister from appearing before investigators. “I don’t know where he became a medical practitioner or Surgeon General,” Davies stated, adding, “He should stick to his mandate. This theatrics is unnecessary.”

Davies confirmed that proper medical documentation detailing Ofori-Atta’s unavailability was sent to the Special Prosecutor’s office. He questioned Agyebeng’s authority to dismiss the medical report as “pointless,” asking, “Does it lie in his domain to make this comment?” The criticism intensified following the Special Prosecutor’s public remarks suggesting a potential trial in absentia if Ofori-Atta remains unavailable. Davies questioned both the legality and intent behind this suggestion, warning, “He says he’s going to try him in absentia. Has he exhausted all the legal avenues? We are all lawyers. We also know what to do.”

Davies expressed significant ethical concerns regarding Agyebeng’s alleged public disclosure that Ofori-Atta had been “diagnosed with cancer.” “If he goes on to say that Ofori-Atta has been diagnosed with cancer, does he appreciate what that means? When did he transmogrify to be a doctor?” Davies asked, challenging the propriety of the Special Prosecutor’s commentary on sensitive personal health matters. The dispute highlights escalating tensions between Ofori-Atta’s defense and the Office of the Special Prosecutor regarding investigative procedures and the boundaries of prosecutorial authority.
