Ga South Assembly plots to undermine Adam Nana

In its zealous bid to evict Adam Nana, the local PROTOA Chairman and his Transport Union from Mallam Junction in Accra, the Ga South Metropolitan Assembly (GSMA) has set for itself to tread on a slippery path to meet the phenomenon called “Contempt of Court”.

GSMA, which embarked on this eviction exercise last year, was dragged to court by Adam Nana, over the issue with the case still pending in court.

In his injunction notice dated 25th August 2015 against the exercise, Adam Nana claimed the Assembly had been threatening him with eviction from his own land on which he has operated his transport business for over fifteen years (15).

His six-point affidavit in support of the suit indicated among others that he has the necessary statutory license to operate the station and that the indented action is unlawful and irregular, since he has obtained a license to operate from the Assembly.

However, before the case could be called for the first time, the Assembly, in a fresh move, has issued what it termed “find warning”  to Adam Nana and his Union, giving them Monday, February 1st 2016 as the ultimatum date to quite the station and move to the newly prepared Bus terminal at Kokroko, Mallam.

The last warning letter, dated 26th January, 2016 with reference number DO1451/12/71, signed by Ben Armah, Municipal Coordinating Director for the Municipal Chief Executive (MCE), Jerry Acquaye Thompson, maintained that failure to comply with this order will lead to prosecution by the GSMA, and that for further, information he should be reached on telephone no 0244528664.

Unhappy with this development, lawyer for Adam Nana Tawiah Yoyowa Esq. has issued a fresh motion of notice of interim injunction dated 29th January, 2016 to the Assembly to be moved in the Accra high court on February 12, 2016

The affidavit in support of the motion indicated that Adam Nana and his Union have the authority and consent of the Assembly to operate the station. We gathered that the Assembly recently issued ‘trotro tickets’ and station ticket worth over GH¢ 1,000.00 to Adam Nana.

The motion also indicated that Adam Nana instituted the court action over these same threats, which have been revisited this year. And that this action by the Assembly court is unlawful and irregular, because he has obtained permit from the Assembly to operate on his said Land.

Also, the Assembly has no locus or mandate to issue or revisit this threat pending the outcome of the case in court. Lawyer Tawiah wandered if the action of the Assembly was not pre-judicial, urging the court to further restrain the Assembly from its intend action pending the outcome at the case in court.
